K&H Gems DMCC, a company organised under DMCC Free Zone authority, Almas Tower, Jumeirah Lakes Towers, Dubai, UAE. "We", "our", "TopGems" refer to this entity. "You", "buyer", "customer" refer to the person or organisation placing an order.

We only contract with adults (18+) or legal entities. Minors may not purchase independently.

You must provide accurate information at registration and keep it current. You are responsible for all activity under your credentials. Report suspected account compromise to security@topgems.com — we will freeze the account within one business hour.

You may close your account at any time (account settings → delete account). Closed accounts retain anonymised order history for 10 years per UAE accounting / tax law.

Catalog prices are in USD. Display in EUR / AED / THB / CNY is presentational only — all settlement is in USD. Your bank may apply its own conversion fee on top. FX rates used for display are locked for 30 minutes from the moment a stone enters your cart.

Orders are accepted only when you receive a confirmation email with an invoice and order number. Before that, a reservation (30 minutes) holds the stone for you but no contract exists. Pricing errors discovered before shipping entitle us to cancel and fully refund without penalty.

We accept Visa / Mastercard / Amex via Stripe (3D Secure required above \$1,000), PayPal, BitPay for Bitcoin / Ethereum / USDC, and bank wire for orders above \$10,000. Diamond orders above \$20,000 use a two-step capture: authorise → verify price and availability → capture or cancel.

High-value orders (> \$10,000) undergo manual review. Orders ≥ \$15,000 require KYC documentation; ≥ \$50,000 also source-of-funds. All payments must be in the buyer's own name — third-party payments are refused under AML rules.

International shipments travel under HS code 7103 (precious stones — natural) on DAP (Delivered at Place) Incoterms via DHL Express or Malca-Amit. You are the importer of record; destination duties, VAT, and import taxes are your responsibility.

We declare the full insured value on every customs form. Requests to under-declare are refused without exception — doing so would void your insurance, expose both parties to customs-fraud liability, and invalidate your buyer protection.

Certain origin / destination combinations are blocked (currently: Myanmar and Russian-origin stones to the United States, per US Executive Order 14068 and the G7 Russian diamond restrictions).

Catalog stones are returnable within 14 days of delivery, in original condition, with all certificates and packaging. Bespoke commissions, custom-sized settings, and made-to-order pieces are not returnable once production begins — this is disclosed at commission and again at final payment.

Returns on orders above \$10,000 ship back on our account with a prepaid Malca-Amit / DHL label. Refunds issue to the original payment method within 5–7 business days after an independent gemologist inspects the returned stone.

Damaged-in-transit claims are handled via the carrier's insurance — inspect the parcel in the courier's presence and refuse delivery if tampering is evident.

These terms are governed by the laws of the United Arab Emirates. For disputes arising out of B2C purchases, jurisdiction sits with the Dubai Courts (DMCC jurisdiction clause applies to dealer contracts — different venue, see the Dealer Agreement).

Before any court proceeding, parties agree to attempt good-faith resolution for 30 days via written correspondence with legal@topgems.com. Consumer rights under your country of residence that cannot be waived by contract remain unaffected.

We may update these terms at any time. Material changes are emailed to registered customers 14 days before taking effect; minor corrections take effect on publication.
